제1조(목적)
이 약관은 Autodata Online Korea(전자상거래 사업자)(이)가 운영하는 Autodata Online Korea(이하 "몰"이라 한다)에서 제공하는 인터넷 관련 서비스(이하 "서비스"라 한다)를 이용함에 있어 사이버 몰과 이용자의 권리·의무 및 책임사항을 규정함을 목적으로 합니다. ※「PC통신, 무선 등을 이용하는 전자상거래에 대해서도 그 성질에 반하지 않는 한 이 약관을 준용합니다」
제2조(정의)
"몰" 이란 Autodata Online Korea(이)가 재화 또는 용역(이하 "재화등"이라 함)을 이용자에게 제공하기 위하여 컴퓨터등 정보통신설비를 이용하여 재화등을 거래할 수 있도록 설정한 가상의 영업장을 말하며, 아울러 사이버몰을 운영하는 사업자의 의미로도 사용합니다.
"이용자"란 "몰"에 접속하여 이 약관에 따라 "몰"이 제공하는 서비스를 받는 회원 및 비회원을 말합니다.
'회원'이라 함은 "몰"에 개인정보를 제공하여 회원등록을 한 자로서, "몰"의 정보를 지속적으로 제공받으며, "몰"이 제공하는 서비스를 계속적으로 이용할 수 있는 자를 말합니다.
'비회원'이라 함은 회원에 가입하지 않고 "몰"이 제공하는 서비스를 이용하는 자를 말합니다.
제3조 (약관등의 명시와 설명 및 개정)
"몰"은 이 약관의 내용과 상호 및 대표자 성명, 영업소 소재지 주소(소비자의 불만을 처리할 수 있는 곳의 주소를 포함), 전화번호·모사전송번호·전자우편주소, 사업자등록번호, 통신판매업신고번호, 개인정보관리책임자등을 이용자가 쉽게 알 수 있도록 "몰"의 초기 서비스화면(전면)에 게시합니다. 다만, 약관의 내용은 이용자가 연결화면을 통하여 볼 수 있도록 할 수 있습니다.
"몰은 이용자가 약관에 동의하기에 앞서 약관에 정하여져 있는 내용 중 청약철회·배송책임·환불조건 등과 같은 중요한 내용을 이용자가 이해할 수 있도록 별도의 연결화면 또는 팝업화면 등을 제공하여 이용자의 확인을 구하여야 합니다.
"몰"은 전자상거래등에서의소비자보호에관한법률, 약관의규제에관한법률, 전자거래기본법, 전자서명법, 정보통신망이용촉진등에관한법률, 방문판매등에관한법률, 소비자보호법 등 관련법을 위배하지 않는 범위에서 이 약관을 개정할 수 있습니다.
"몰"이 약관을 개정할 경우에는 적용일자 및 개정사유를 명시하여 현행약관과 함께 몰의 초기화면에 그 적용일자 7일이전부터 적용일자 전일까지 공지합니다.
, 이용자에게 불리하게 약관내용을 변경하는 경우에는 최소한 30일 이상의 사전 유예기간을 두고 공지합니다. 이 경우 "몰"은 개정전 내용과 개정후 내용을 명확하게 비교하여 이용자가 알기 쉽도록 표시합니다.
"몰"이 약관을 개정할 경우에는 그 개정약관은 그 적용일자 이후에 체결되는 계약에만 적용되고 그 이전에 이미 체결된 계약에 대해서는 개정전의 약관조항이 그대로 적용됩니다. 다만 이미 계약을 체결한 이용자가 개정약관 조항의 적용을 받기를 원하는 뜻을 제3항에 의한 개정약관의 공지기간내에 '몰"에 송신하여 "몰"의 동의를 받은 경우에는 개정약관 조항이 적용됩니다.
이 약관에서 정하지 아니한 사항과 이 약관의 해석에 관하여는 전자상거래등에서의소비자보호에관한법률, 약관의규제등에관한법률, 공정거래위원회가 정하는 전자상거래등에서의소비자보호지침 및 관계법령 또는 상관례에 따릅니다.
제4조(서비스의 제공 및 변경)
"몰"은 다음과 같은 업무를 수행합니다.
- 또는 용역에 대한 정보 제공 및 구매계약의 체결
- 체결된 재화 또는 용역의 배송
- "몰"이 정하는 업무
"몰"은 재화 또는 용역의 품절 또는 기술적 사양의 변경 등의 경우에는 장차 체결되는 계약에 의해 제공할 재화 또는 용역의 내용을 변경할 수 있습니다. 이 경우에는 변경된 재화 또는 용역의 내용 및 제공일자를 명시하여 현재의 재화 또는 용역의 내용을 게시한 곳에 즉시 공지합니다.
"몰"이 제공하기로 이용자와 계약을 체결한 서비스의 내용을 재화등의 품절 또는 기술적 사양의 변경 등의 사유로 변경할 경우에는 그 사유를 이용자에게 통지 가능한 주소로 즉시 통지합니다.
전항의 경우 "몰"은 이로 인하여 이용자가 입은 손해를 배상합니다. 다만, "몰"이 고의 또는 과실이 없음을 입증하는 경우에는 그러하지 아니합니다.
제5조(서비스의 중단)
"몰"은 컴퓨터 등 정보통신설비의 보수점검·교체 및 고장, 통신의 두절 등의 사유가 발생한 경우에는 서비스의 제공을 일시적으로 중단할 수 있습니다.
"몰"은 제1항의 사유로 서비스의 제공이 일시적으로 중단됨으로 인하여 이용자 또는 제3자가 입은 손해에 대하여 배상합니다. 단, "몰"이 고의 또는 과실이 없음을 입증하는 경우에는 그러하지 아니합니다.
사업종목의 전환, 사업의 포기, 업체간의 통합 등의 이유로 서비스를 제공할 수 없게 되는 경우에는 "몰"은 제8조에 정한 방법으로 이용자에게 통지하고 당초 "몰"에서 제시한 조건에 따라 소비자에게 보상합니다. 다만, "몰"이 보상기준 등을 고지하지 아니한 경우에는 이용자들의 마일리지 또는 적립금 등을 "몰"에서 통용되는 통화가치에 상응하는 현물 또는 현금으로 이용자에게 지급합니다.
제6조(회원가입)
이용자는 "몰"이 정한 가입 양식에 따라 회원정보를 기입한 후 이 약관에 동의한다는 의사표시를 함으로서 회원가입을 신청합니다.
"몰"은 제1항과 같이 회원으로 가입할 것을 신청한 이용자 중 다음 각호에 해당하지 않는 한 회원으로 등록합니다.
- 이 약관 제7조제3항에 의하여 이전에 회원자격을 상실한 적이 있는 경우, 다만 제7조제3항에 의한 회원자격 상실후 3년이 경과한 자로서 "몰"의 회원재가입 승낙을 얻은 경우에는 예외로 한다.
- 내용에 허위, 기재누락, 오기가 있는 경우
- 회원으로 등록하는 것이 "몰"의 기술상 현저히 지장이 있다고 판단되는 경우
회원가입계약의 성립시기는 "몰"의 승낙이 회원에게 도달한 시점으로 합니다.
회원은 제15조제1항에 의한 등록사항에 변경이 있는 경우, 즉시 전자우편 기타 방법으로 "몰"에 대하여 그 변경사항을 알려야 합니다.
제7조(회원 탈퇴 및 자격 상실 등)
회원은 "몰"에 언제든지 탈퇴를 요청할 수 있으며 "몰"은 즉시 회원탈퇴를 처리합니다.
회원이 다음 각호의 사유에 해당하는 경우, "몰"은 회원자격을 제한 및 정지시킬 수 있습니다.
- 신청시에 허위 내용을 등록한 경우
-몰"을 이용하여 구입한 재화등의 대금, 기타 "몰"이용에 관련하여 회원이 부담하는 채무를 기일에 지급하지 않는 경우"모
- 사람의 "몰" 이용을 방해하거나 그 정보를 도용하는 등 전자상거래 질서를 위협하는 경우
-몰"을 이용하여 법령 또는 이 약관이 금지하거나 공서양속에 반하는 행위를 하는 경우
-Autodata Ltd. "Product Terms and Conditions"에 의거하여 1 곳의 사업자에서 1개의 라이센스를 가입하여 사용하여야 하며, 복수의 곳의 사업자에서 1개의 라이센스/다중 사용자 상품을 공동으로 사용하는 경우, 그에 따른 손해배상을 청구할 수 있습니다.
-"몰"에서 판매하는 모든 상품은 영국 Autodata Ltd. 의 지적재산권이 적용된 상품으로, 정당한 업체에서의 사용 외에, 무단 배포 혹은 해당 업체의 영리활동에 동의없이 무단으로 사용할 경우 손해배상을 청구할 수 있습니다.
"몰"이 회원 자격을 제한·정지 시킨후, 동일한 행위가 2회이상 반복되거나 30일이내에 그 사유가 시정되지 아니하는 경우 "몰"은 회원자격을 상실시킬 수 있습니다.
"몰"이 회원자격을 상실시키는 경우에는 회원등록을 말소합니다. 이 경우 회원에게 이를 통지하고, 회원등록 말소전에 최소한 30일 이상의 기간을 정하여 소명할 기회를 부여합니다.
제8조(회원에 대한 통지)
"몰"이 회원에 대한 통지를 하는 경우, 회원이 "몰"과 미리 약정하여 지정한 전자우편 주소로 할 수 있습니다.
"몰"은 불특정다수 회원에 대한 통지의 경우 1주일이상 "몰" 게시판에 게시함으로서 개별 통지에 갈음할 수 있습니다. 다만, 회원 본인의 거래와 관련하여 중대한 영향을 미치는 사항에 대하여는 개별통지를 합니다.
제9조(구매신청)
몰"이용자는 "몰"상에서 다음 또는 이와 유사한 방법에 의하여 구매를 신청하며, "몰"은 이용자가 구매신청을 함에 있어서 다음의 각 내용을 알기 쉽게 제공하여야 합니다. 단, 회원인 경우 제2호 내지 제4호의 적용을 제외할 수 있습니다.
- 검색 및 선택
-, 주소, 전화번호, 전자우편주소(또는 이동전화번호) 등의 입력
-, 청약철회권이 제한되는 서비스, 배송료·설치비 등의 비용부담과 관련한 내용에 대한 확인
제10조(결제관련)
"몰"이용자는 "몰"상에서 구매신청을 함과 동시에 전자결제를 하여 구매를 완료하게 됩니다. 해당 상품은 온라인 구독 상품으로 연간구독/매월선지불(정기결제) 방식입니다. 연간 구독 만료 30일 전 구독 갱신 관련 안내가 고객에게 전자우편으로 발송되며, 고객의 취소 의사가 없는 경우 자동 재계약 되는 방식입니다.
계약 기간 중 사용료 미 결제 시, 결제가 재개 될 때까지 사용 중지 설정이 되며, 사용료 미 지불로 인한 사용 중지 기간은 사용료 재 결제 후에도 돌려받지 못합니다.
정기 결제 기간에 결제가 이루어지지 않은 경우, 해당 "몰" 관리자에게 알림이 가며, 관리자가 유선 혹은 전자우편으로 결제 실패 관련 내용을 고객과 확인합니다. 고객과 미 결제 사유가 확인되면, 재 결제를 진행하며, 일반적으로 익일 오전9시에 결제가 진행되도록 예약 진행합니다.
정기 결제 등록 카드의 변경 혹은 분실로 인한 카드 번호 변경 시, 기존 구독이 취소되고 새로운 구독으로 다시 결제가 진행됩니다.
제11조(구독취소)
"몰"이용자는 "몰"상에서 구독 진행한 상품을 구독 취소 할 수 있습니다. 구독 취소 및 환불 방침은 하기 내용에 따릅니다.
- "몰"에 회원 가입 후 상품 결제가 완료되어, Autodata Workshop 사용 아이디가 발급 후 : 기 결제 된 금액이 환불되지 않으며, 결제된 만큼의 기간 동안 사용 후, 다음 달 분 정기 결제가 취소되면서 구독 취소
- "몰"에 회원 가입 후 상품 결제 완료되고 Autodata Workshop 사용 아이디 발급 전 : 마이페이지를 통하여 취소 신청 접수되면 구매 취소 후 카드사에 결제 취소 요청이 들어가게 됩니다. 결제된 금액의 환불 여부는 카드사 방침에 따라 3~5일의 기간이 소요될 수 있습니다.
제12조(상품이용)
"몰"이용자가 "몰"상에서 구독하는 상품은 영국 Autodata Ltd.에서 제공하는 서비스로, 해당 서비스에 대한 이용 약관은 하기 Autodata Ltd.의 영문 "Product Terms & Conditions"를 따릅니다.
Autodata Limited is a limited company registered in England and Wales under company number 01062727 with its registered office at Priors Way, Maidenhead, Berkshire, SL6 2HP (‘Autodata’).
Access to Autodata’s database by You is controlled by an electronic permit activated by entering a username and password. The usernames and passwords are supplied by Autodata or its authorised agent on a subscription basis.
By accessing Autodata’s database and by paying the Subscription Fee, You agree to be bound by the terms and conditions of this Licence. In exchange, Autodata will grant You a licence to access and use the Autodata Information on the following terms and conditions:
1. Definitions
In this Licence, the following words will have the following meanings:
"Autodata Information" means the information gathered by Autodata and published on the Subscription Area of the Autodata Website;
"Autodata Website" means the website at workshop.autodata-group.com or such other website that Autodata may notify to You;
"Intellectual Property Rights" mean any patents, copyright, designs, utility models, trade marks, trade names, domain names, database rights, rights in know-how and confidential information and all other intellectual and industrial property and similar, whether registered or unregistered or analogous rights existing under the laws of any country;
"Licence Agreement" means this User Subscription Licence;
"Registration Form" means the form (electronic or otherwise) completed by setting out Your details, the Subscription Period and the Subscription Fee payable; where there is any inconsistency between this Licence and the Registration Form, the terms and conditions of this Licence Agreement shall prevail;
"Subscription Area" means that part of the Autodata Website which is only accessible by entering a valid username and password and which contains the Autodata Information;
"Subscription Fee" means the fee agreed between You and Autodata, as are set out in the Registration Form;
"Subscription Period" means the period for which You have paid the Subscription Fee to access the Autodata Information as set out on the Registration Form; and
"You" means the organisation paying to have access to the Autodata Information, and
"Your" will be construed accordingly.
2. Licence Grant
2.1. On receipt of the correctly completed Registration Form and in consideration of (and receipt of) payment by You of Subscription Fee to Autodata, Autodata grants You online-only access to the Subscription Area and grants You a non-exclusive non-transferable limited licence to view the Autodata Information on the Subscription Area for the Subscription Period subject to the terms and conditions of this Licence Agreement.
2.2. The licence granted under clause 2.1 is issued in respect of the single physical site or address stated on the Registration Form and covers the viewing of Autodata Information by a single internet-connected device in use at any given time at that location. You will be issued with a single username and password and will ensure that such username and password are not disclosed to any third party or used other than as permitted in these Terms and Conditions. You agree to indemnify Autodata from and against any loss, liability, damages or costs to Autodata or third parties from Your failure to comply with this obligation. You shall notify Autodata in writing immediately if the security of a password has been compromised.
2.3. Viewing of the Autodata Information by additional internet-connected devices at the location applicable in paragraph 2.2, will be granted at Autodata’s discretion and will be subject to the completion of further Registration Forms and additional subscription fees, for which additional usernames and passwords will be issued.
2.4. You may only use the Autodata Information as a source of reference for the purposes of maintaining and repairing motor vehicles.
2.5. Only You and Your employees are authorised to use the username and password Autodata give to You in accordance with paragraph 2.2, and You will not disclose or authorise the disclosure of the username and password on to any other party.
2.6. You may not use, copy, download, rent, lend, lease, sell, distribute, transmit or otherwise transfer any Autodata Information or any copy, modification, translation or adaptation of any Autodata Information except as permitted by law or expressly set out in this Licence. You may not “crawl” or otherwise access the Autodata Information, whether manually or by automated means, to reproduce any part of the Autodata Information in any form. You may not reverse compile, disassemble, reverse engineer or create derivative works based on all or any portion of the Autodata Information.
2.7. During the Subscription Period and for a period of 12 months following its termination (for whatsoever reason), You must permit Autodata and its representatives, at all reasonable times and on reasonable advance notice, to inspect and have access to any premises, and to the computer equipment located there, at which the Autodata Information is (or was) being used, and any records kept pursuant to this Licence Agreement, for the purpose of ensuring that You are complying with this Licence Agreement.
2.8. You agree that Autodata may monitor Your online use of the Subscription Area, for example to ensure compliance with this paragraph 2 or to collect statistics relating to the use of the Autodata Website. If Autodata reasonably establishes that you are accessing or otherwise using the Subscription Area other than in accordance with this Licence, Autodata has the right to immediately suspend or terminate your access to the Subscription Area with no obligation to repay You any part of the Subscription Fee.
2.9. You agree that in the course of Your use of the Subscription Area, You may choose to upload to the Subscription Area for ease of reference certain information relating to You or Your customers or commercial partners (including details of your physical location(s), names of Your employees accessing the Subscription Area, makes and models of motor vehicles owned by Your customers or commercial partners, etc.). Such information remains Your property at all times, and You can choose to delete such information from the Subscription Area at any time. By uploading such information to the Subscription Area, You consent to Autodata storing a copy of that information. Autodata shall comply with all statutory requirements relating to processing of such information, and will ensure the privacy of such information at all times.
2.10. You may not use (or permit to be used by any third party) the Autodata Information in relation to the maintenance or repair of any motor vehicles which are or may reasonably be suspected to be used for military purposes or in connection with the transportation or storage of weapons of mass destruction, or otherwise in contravention of European Union or any other regulations. You must immediately notify Autodata in writing if you become aware of or suspect that the Autodata Information made available to You or Your access to the Subscription Area has been used in this way.
2.11. You must comply with all applicable laws and regulations in force from time to time in the location from which you access the Autodata Information and the Subscription Area, and must not use (or permit to be used) the Autodata Information in connection with any illegal activities.
3. Duration
3.1. Unless Autodata terminates it in accordance with clauses 2.8 above or 6.2 below, this Licence Agreement will begin on the date on which Autodata issues You with a username and password to access the Subscription Area and will continue for the Subscription Period.
3.2. Unless we receive notice from you within the last 30 days of the Subscription Period (and any subsequent renewals thereof) that you wish to terminate this Licence Agreement, this Licence Agreement will be automatically renewed for a further Subscription Period of 12 months or to the period specified in your contract where relevant, and you will be required to pay a further fee. This further fee will be automatically charged to any payment means that you have authorised us to retain on our records, or where relevant to the channel through which you purchased your subscription, otherwise you will be issued with an invoice. If You do not pay the further Subscription Fee in respect of any renewal of this Licence Agreement when it falls due, Autodata may suspend or terminate your access to the Subscription Area.
4. Warranties and Indemnities
4.1. The Autodata Information has been compiled by Autodata from information supplied by vehicle and component manufacturers and from the results of tests carried out by Autodata. All reasonable care has been taken to ensure the accuracy of such information. Nevertheless, Autodata give no warranty that the Autodata Information is complete or accurate and, to the maximum extent permitted by law, Autodata will accept no liability arising from any inaccuracy or incompleteness of the Autodata Information.
4.2. The Autodata Information was compiled for use with vehicles manufactured to European specifications. You should be aware that in countries outside Europe model names and descriptions and the specifications relating to them may differ from those listed in the Autodata Information.
4.3. The Autodata Information is provided ‘AS IS’ and all conditions or warranties express or implied, statutory or otherwise (including without limitation those pertaining to accuracy, completeness, currency, non-infringement, merchantability or fitness for a particular purpose (whether or not notified) of any product) are hereby excluded.
4.4. Autodata makes all reasonable efforts to ensure the Autodata Website is free from computer viruses, Trojans and other malicious code, however You should ensure that You use adequate, up to date, anti-virus software. Autodata will accept no liability arising from any infection by computer viruses or other malicious code.
4.5. Autodata makes all reasonable efforts to ensure that the Autodata Website is available, on some rare occasions the number of users accessing it may cause it to run slowly, and on other occasions it may be temporarily unavailable whilst it is being serviced or repaired. Whilst Autodata will endeavour to warn users of scheduled service interruptions, Autodata does not warrant that the site will be accessible at all times. To the maximum extent permitted by law, Autodata will accept no liability arising from the inability of users to access the Autodata Information or any slow running of the Autodata website.
4.6. Your sole remedy and the entire liability of Autodata are as set out in this Licence Agreement and in no event shall Autodata be liable to You or any other person for any loss of revenue, loss of actual or anticipated profits whether arising in the normal course of business or otherwise (including, without limitation, loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of or damage to reputation; loss of or corruption to data; loss of management or administration time, legal and other professional fees and expenses; or any indirect or consequential loss or damages however caused which arise directly or indirectly from the subject matter of this Licence Agreement or the use or inability to use the Autodata Website.
4.7. You hereby indemnify and hold harmless Autodata from and against all liability, cost (including legal costs), damage, loss, action, claim or proceedings arising directly or indirectly as a result of any unauthorised use by You (or Your employees or any third party to whom You or Your Employees have granted access to the Autodata Information) of the Autodata Information or of the Autodata Website, whether in compliance with the terms of this Licence Agreement or otherwise. You will provide Autodata with any evidence or information in your possession or control reasonably requested by Autodata in relation to your use of the Autodata Information in the event that Autodata is subjected to any challenge, claim, or complaint relating to your use of the Autodata Information.
4.8. Except as set out in this Licence Agreement or as required by law, no other warranties (whether express or implied) are made in respect of the Autodata Information or the Autodata Website. Nothing in this Agreement shall operate to exclude or restrict the liability of either Party for death or personal injury due to its negligence, nor for fraudulent misrepresentation, or any liability which cannot be excluded by law.
5. Rights in the Autodata Information
5.1. All Intellectual Property Rights in the Autodata Information are owned by Autodata Limited and/or its licensors. You shall not have any rights in or to the Autodata Information other than the rights specifically granted under this Licence Agreement and the Registration Form and all rights not expressly granted to You are reserved by Autodata.
5.2. The copyright and database rights notice included in Autodata Information must at all times remain an integral part of the Autodata Information and any permitted copy.
5.3. AUTODATA and the Autodata logo are registered trade marks of Autodata Limited.
5.4. You hereby assign (and shall procure the assignment from any of Your employees) at no cost to Autodata all rights (including copyright) in any content relating to the repair and maintenance of motor vehicles that You provide or make available (e.g. by email or by posting on Autodata’s user forums or such similar other public facilities owned or operated by Autodata) to Autodata which supplements the Autodata Information.
6. General
6.1. You shall not transfer, assign, sub-license or otherwise dispose of all or any part of this Licence Agreement, or any of Your rights or obligations arising under it without the prior written consent of Autodata.
6.2. In the event that You fail to comply with the terms and conditions of this Licence Agreement, Autodata shall be entitled to terminate this Licence Agreement granted to You with immediate effect and without notice. On expiry of this Licence Agreement for whatsoever reason, all rights granted to You under this Licence Agreement shall cease.
6.3. You consent to Autodata storing Your payment information to facilitate payment of future subscription fees. Autodata shall comply with all data protection legislation in the storing and processing of any personal data.
6.4. Autodata may update the terms of this Licence Agreement from time to time by written notice to You.
6.5. If any provision of this Licence Agreement is declared void or unenforceable the remaining provisions of this Licence Agreement shall remain in full force and effect.
6.6. Nothing in this Licence Agreement shall be deemed to constitute a partnership between the Parties nor constitute any Party the agent of the other Party.
6.7. Nothing in this Licence Agreement is intended to confer any benefit on any third party (whether such benefit would have arisen under the Contracts (Rights of Third Parties) Act 1999 or otherwise) and no term will be enforceable by any third party.
6.8. No amendment or variation to this Licence Agreement shall take effect unless it is in writing, signed by authorised representatives of each of the Parties.
6.9. This Licence Agreement and the Registration Form constitute the entire agreement between You and Autodata and supersedes any previous arrangement, understanding or agreement between You and Autodata relating to the Autodata Information. To the extent that there is a discrepancy between this Licence Agreement and the Registration Form, the terms of this Licence Agreement shall prevail.
6.10. This Licence Agreement shall be governed by and construed in accordance with the laws of England and Wales and the Courts of England and Wales shall have non-exclusive jurisdiction.
7. Cookies
7.1. Cookies enable us to identify your device, or you when you have logged in. Autodata uses cookies that are strictly necessary to enable you to move around the site or to provide certain basic features. We use cookies to enhance the functionality of the website. We also use cookies to help us to improve the performance of our website to provide you with a better user experience. We don’t sell the information collected by cookies.
7.2. You consent to Autodata storing cookies on your device(s) for the purposes outlined in 7.1.
